Salari\u00e9 d\u00e9tach\u00e9 ou salari\u00e9 expatri\u00e9 ? Le retour en France est ainsi facilit\u00e9.<\/p>\n<p>Lorsqu\u2019il d\u00e9cide d\u2019<strong>expatrier un salari\u00e9<\/strong>, l\u2019employeur met fin \u00e0 ses obligations vis-\u00e0-vis de la S\u00e9curit\u00e9 sociale et ne doit plus lui verser de cotisations car le salari\u00e9 est d\u00e9sormais affili\u00e9 au r\u00e9gime de protection sociale de son pays d\u2019expatriation.<\/p>\n<h5>Comment faire le bon choix ?<\/h5>\n<p style=\"text-align: justify;\">Avant de prendre sa d\u00e9cision, l\u2019employeur doit v\u00e9rifier si la\u00a0<strong>dur\u00e9e de mission<\/strong>\u00a0du salari\u00e9 correspond \u00e0 une dur\u00e9e possible dans le cadre du d\u00e9tachement. Ce mode d\u2019envoi est en effet r\u00e9glement\u00e9 et suppose une dur\u00e9e maximale :<\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong>de deux ans s\u2019il s\u2019agit d\u2019un d\u00e9tachement au sein de l\u2019Union europ\u00e9enne (la dur\u00e9e va \u00eatre raccourcie \u00e0 un an suite \u00e0 la <a href=\"http:\/\/www.lemoniteur.fr\/article\/travail-detache-macron-obtient-une-limitation-a-12-mois-34924973\">r\u00e9forme de la directive europ\u00e9enne du travail d\u00e9tach\u00e9<\/a>).\u00a0<\/strong><\/li>\n<li style=\"text-align: justify;\"><strong>de cinq ans s\u2019il est effectu\u00e9 hors de l\u2019UE mais avec un Etat avec lequel la France a sign\u00e9 <a href=\"http:\/\/www.cleiss.fr\/docs\/textes\/\" target=\"_blank\" rel=\"noopener noreferrer\">une convention bilat\u00e9rale<\/a> ; la dur\u00e9e sera fix\u00e9e dans le contenu m\u00eame de la convention.<\/strong><\/li>\n<li style=\"text-align: justify;\"><strong>de six ans s\u2019il est effectu\u00e9 hors de l\u2019UE et qu\u2019aucun accord bilat\u00e9ral n\u2019a \u00e9t\u00e9 sign\u00e9 avec la France.<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">G\u00e9n\u00e9ralement, l\u2019un des premiers \u00e9l\u00e9ments que l\u2019employeur consid\u00e8re lorsqu\u2019il compare d\u00e9tachement et expatriation est le facteur financier. Afin de limiter ses frais de fa\u00e7on optimale, il \u00e9valuera le co\u00fbt global\u00a0<strong>des d\u00e9penses<\/strong>\u00a0engendr\u00e9es par l\u2019expatriation et le d\u00e9tachement.<\/p>\n<p style=\"text-align: justify;\">Il ne faut pas oublier que le salari\u00e9 qui accepte d\u2019\u00eatre d\u00e9tach\u00e9 \u00e0 l\u2019\u00e9tranger refusera de perdre une partie de son salaire pour faire face aux difficult\u00e9s engendr\u00e9es par le d\u00e9tachement. C\u2019est pourquoi, l\u2019employeur devra sans doute lui octroyer des primes, des avantages en nature, en contrepartie de son travail \u00e0 l\u2019\u00e9tranger et verra ainsi l\u2019assiette des cotisations augmenter consid\u00e9rablement.<\/p>\n<h5>Prendre en compte le\u00a0pays de destination<\/h5>\n<p style=\"text-align: justify;\">Parfois, en fonction du co\u00fbt des frais de sant\u00e9 dans le pays de destination, l\u2019employeur peut pr\u00e9f\u00e9rer choisir l\u2019expatriation au d\u00e9tachement.<\/p>\n<p style=\"text-align: justify;\">Si le d\u00e9tachement a lieu dans <a href=\"http:\/\/www.cleiss.fr\/docs\/textes\/\">un pays li\u00e9 avec une convention de s\u00e9curit\u00e9 sociale avec la France<\/a>, les frais m\u00e9dicaux du d\u00e9tach\u00e9 sont rembours\u00e9s selon la l\u00e9gislation sociale et les formalit\u00e9s en vigueur dans ce pays. Mais dans le cadre d\u2019un d\u00e9tachement dans un pays n\u2019ayant pas de convention de s\u00e9curit\u00e9 sociale avec la France, les remboursements de l\u2019Assurance maladie fran\u00e7aise se font uniquement sur la base des frais r\u00e9els et dans la limite des tarifs forfaitaires fran\u00e7ais. Ainsi, dans \u00a0les pays o\u00f9 les frais de sant\u00e9 sont plus \u00e9lev\u00e9s qu\u2019en France, l\u2019employeur devra souscrire \u00e0 une assurance suppl\u00e9mentaire offrant \u00e0 son salari\u00e9 d\u00e9tach\u00e9 une pris en charge plus compl\u00e8te de ses d\u00e9penses de sant\u00e9 (de nombreuses mutuelles fran\u00e7aises ne couvrent pas les d\u00e9penses de sant\u00e9 \u00e0 l\u2019\u00e9tranger). Pour r\u00e9sumer, le d\u00e9tachement peut s\u2019av\u00e9rer tr\u00e8s co\u00fbteux lorsqu\u2019il est r\u00e9alis\u00e9 dans un pays non li\u00e9 par une convention bilat\u00e9rale avec la France car l\u2019employeur est dans ce cas-l\u00e0 confront\u00e9 \u00e0 une double affiliation de son salari\u00e9.<\/p>\n<p style=\"text-align: justify;\">L\u2019expatriation est donc la solution la plus \u00e9conomique lorsque le salari\u00e9 part travailler dans un pays sans convention de s\u00e9curit\u00e9 sociale avec la France et dans lequel le co\u00fbt des frais de sant\u00e9 est \u00e9lev\u00e9. L\u2019employeur peut choisir diff\u00e9rents moyens d\u2019assurer son salari\u00e9. Tout d\u2019abord, il peut assurer son employ\u00e9 localement uniquement (un choix qu\u2019il \u00e9cartera dans les pays o\u00f9 le syst\u00e8me de sant\u00e9 local est d\u00e9faillant), combiner l\u2019assurance volontaire des expatri\u00e9s propos\u00e9e par la\u00a0<a href=\"https:\/\/www.expatassure.com\/fr\/la-cfe\/\">Caisse des Fran\u00e7ais de l\u2019\u00e9tranger (CFE)<\/a>\u00a0et une assurance compl\u00e9mentaire. L\u2019employeur peut \u00e9galement choisir une assurance sant\u00e9 internationale au premier euro, qui peut \u00eatre plus ou moins avantageuse selon la situation du salari\u00e9 expatri\u00e9 (consulter la page\u00a0<a href=\"https:\/\/www.expatassure.com\/fr\/votre-choix-de-couverture-medicale\/\">Votre choix de couverture m\u00e9dicale\u00a0<\/a>qui compare les principaux avantages et inconv\u00e9nients des assurances au premier euro et de la formule CFE + compl\u00e9mentaire).<\/p>\n<p style=\"text-align: justify;\">En conclusion,\u00a0si le salari\u00e9 est envoy\u00e9 dans un pays o\u00f9 la couverture maladie est d\u2019un bon niveau, l\u2019employeur ferait mieux de choisir l\u2019expatriation quitte \u00e0 compl\u00e9ter la couverture sociale par une assurance volontaire pour la vieillesse. Cela tombe sous le sens car pourquoi continuer de payer les cotisations \u00e0 la S\u00e9curit\u00e9 sociale fran\u00e7aise pour pouvoir b\u00e9n\u00e9ficier d\u2019une bonne couverture sociale s\u2019il peut payer moins cher et b\u00e9n\u00e9ficier d\u2019une aussi bonne couverture en \u00e9tant expatri\u00e9 ?<\/p>\n<p style=\"text-align: justify;\">Quoi qu\u2019il en soit, il faut garder \u00e0 l\u2019esprit qu\u2019en cas d\u2019expatriation, le salari\u00e9 doit certes \u00eatre affili\u00e9 au r\u00e9gime local mais l\u2019employeur n\u2019est en aucun cas oblig\u00e9 de lui prendre une assurance compl\u00e9mentaire, bien que cela soit fortement conseill\u00e9, notamment si le salari\u00e9 est envoy\u00e9 dans un pays o\u00f9 la protection sociale est faible ou d\u00e9faillante.<\/p>\n<p style=\"text-align: justify;\">Enfin, le\u00a0<strong>niveau de responsabilit\u00e9<\/strong>\u00a0de l\u2019employeur pourrait le pousser \u00e0 choisir tel ou tel mode d\u2019envoi. Effectivement, avec le d\u00e9tachement, l\u2019employeur devra continuer \u00e0 respecter ses obligations li\u00e9es \u00e0 l\u2019assujettissement de ses salari\u00e9s, alors que l\u2019employeur qui choisit l\u2019expatriation n\u2019aura plus aucune obligation vis-\u00e0-vis de la S\u00e9curit\u00e9 sociale en termes de cotisations.<\/p>\n<p style=\"text-align: justify;\">Toutefois, l\u2019employeur qui choisit l\u2019expatriation conna\u00eetra une autre obligation : celle d\u2019informer les salari\u00e9s expatri\u00e9s au regard de l\u2019assurance vieillesse ; un devoir qui ne s\u2019imposera cependant pas \u00e0 l\u2019employeur qui choisit de d\u00e9tacher.<\/p>\n<p style=\"text-align: justify;\">Expat Assure peut vous conseiller dans la couverture sociale la plus adapt\u00e9e pour vos salari\u00e9s \u00e0 l\u2019\u00e9tranger ou en cas d\u2019implantation de votre entreprise \u00e0 l\u2019\u00e9tranger.
